Upon the annexed affirmation of M. gallopavo, Esq., subscribed October 24, 2007, the annexed exhibits and upon all the papers and proceedings had heretofore herein, LET the petitioner, N., show cause before me or one of the judges of the Turkey Court of the City of San Mateo, County of San Mateo, at a Motion Part thereof, Part E, located at 2347 Clipper Street, San Mateo, California 94403, on the 22nd day of November, 2007, at 10:30 a.m. or as soon thereafter as counsel can be heard, WHY an order should not be issued, which:

  1. Grants the respondent, M. gallopavo, Esq., application to withdraw as dinner.
  2. Grants the respondent such other and further relief as is deemed just and proper.


          SUFFICIENT CAUSE THEREFORE APPEARING, let service a copy of this order by Samuel Thompson upon the petitioner, N., DEPARTMENT OF ALCOHOL AND PRESERVATION, and M. GALLOPAVO, ESQ., on or before the 24th day of October, 2007 be deemed good and sufficient service.

          PENDING A HEARING AND DETERMINATION OF THIS MOTION, the petitioner, N., its agents, assigns or employees or attorneys are hereby stayed from pursuing any action herein.

. gallopavo, Esq., an atturkey duly admitted to practice law before the Courts of the State of California, hereby affirms, under the penalties of perjury, the following:

  1. I am the dinner of record for the above named petitioner, N. (hereinafter referred to as "the petitioner").
  2. I am fully familiar with the facts and circumstances of this case, except for matters which I allege to be based upon information and belief and as to those matters, I believe them to be true.
  3. I make this application to this Honorable Court to withdraw as dinner in this proceeding based on the following:
    1. I was retained in the position of dinner by the petitioner on the basis of precedents long established.  I respectfully refer the court to N. Rockwell's interpretation of the Four Freedoms doctrine established in ROOSEVELT V. OPPRESSION, 1941.
    2. The petitioner has on several past occasions breached and abused these precedents.  I respectfully refer the court to THOMPSON V. TURKEY, SLING V. ORDER, GRAY V. FOUNTAIN, and PIE V. REASON;  I assert that these are not isolated incidents, but that they represent a pattern of systematic aberrance from standard usage.
    3. I have strong reason to believe that the petitioner's nonstandard usage will continue this year.

WHEREFORE, I pray for the relief requested.
